The agreement between you and the company behind SeeMyPersonality and SMP Assess. Written to be read, and to say exactly what we do.

A plain-English summary, not the agreement itself. Where they differ, the numbered terms apply.
Your assessments, your respondents' answers and your reports belong to you. We host them so the product works, and we never sell them or use them to train AI models.
Section 6We never switch off an assessment or an invitation because a trial ended, a payment failed, a limit was reached or time passed. Responses keep coming in and nothing is deleted.
Section 4If you use results in hiring or at work, a person reviews them and decides, and you follow the employment and privacy laws that apply to you.
Section 7The free plan needs no card. A trial reminds you before it bills. If your first payment for a plan was a mistake, ask within 30 days for your money back.
Section 5Some features use AI to draft questions, summaries and interview kits. Check what it writes before you rely on it. Our AI provider may not train on your data.
Section 8We are an Australian company. Your rights under the Australian Consumer Law and your local law survive, and we give 30 days' notice before any change that matters.
Section 13In shortThis is a contract between you and My Plaza Pty Ltd, the Australian company behind SMP Assess, SeeMyPersonality and Quiz Maker.
SMP Assess and SeeMyPersonality are run by My Plaza Pty Ltd (ABN 58 110 054 245), an Australian company at Suite 1, Ground Floor, Enterprise 1, Innovation Campus UOW, Squires Way, North Wollongong NSW 2500, Australia. In these terms, "we", "us" and "our" mean My Plaza Pty Ltd.
These terms cover smpassess.com, seemypersonality.com, their subdomains, assessment and invitation links, shared report pages, embeds, emails and support. Together we call these the Services.
You accept these terms when you create an account, start a trial or subscription, or otherwise use the Services. If you use the Services for an organisation, you confirm you are authorised to accept these terms for it, and "you" means that organisation.
Our privacy policies for SMP Assess and SeeMyPersonality explain how we handle personal information and form part of these terms. If you have signed a separate agreement with us, such as an order form or a data processing agreement, that document takes priority where the two differ.
Words we use. A Workspace is the account your organisation uses in SMP Assess. A Respondent is anyone who takes an assessment you send or share. Your Content is everything you or your team put into the Services, including assessments, questions, job descriptions, branding and settings. Respondent Data is what Respondents provide, and the scores and reports generated from it.

You must be at least 18 to hold an account. When you register, give accurate details, use an email address you control, and keep your login private. Tell us promptly at support@seemypersonality.com if you think someone has accessed your account without permission.
A Workspace can have several team members with different roles. The Workspace owner decides who is invited, what they can see, and when they are removed, and is responsible for everything done in the Workspace. Your plan sets how many seats you can have.
You can check out as a guest before creating a password. The email address you give at checkout becomes the owner of the Workspace we create for you, and these terms apply from that moment.
In shortFree tests are for self-reflection, not diagnosis. If an organisation invited you, it decides how your results are used.
Free tests on SeeMyPersonality. You can take our tests without an account. They are designed for self-reflection and conversation, based on established personality research. They are not a medical, psychological or clinical assessment, and they do not diagnose any condition. A result describes tendencies at a point in time. It is one input, not a verdict on who you are.
Your result is encoded in its link. Anyone you give that link to can see the result, so share it with care. If you buy something from us as a consumer, the Australian Consumer Law and the consumer laws where you live apply to that purchase.
Assessments sent by an organisation. If an employer, manager or other organisation invited you through SMP Assess, that organisation chose the assessment, sees your results, and decides how they are used. It is responsible to you for that under privacy law, and we handle your data on its behalf. Questions about a decision, or requests to access or delete your data, should go to that organisation first. If you cannot reach them, contact us at support@seemypersonality.com and we will help.
You need to be at least 16 to take an assessment. Please answer honestly and on your own, and do not share assessment questions publicly.
In shortPaid plans renew until you cancel. Going over a limit locks some reports but never stops an assessment collecting responses.
Plans. Current plans and prices are on our pricing page and at checkout. Prices are in US dollars unless checkout says otherwise. Subscriptions are billed monthly or annually and renew automatically, on the same cycle and at the price then in effect, until you cancel. Payments are processed by Stripe. We never see or store your full card number.
Free plan. The free plan needs no card and has no time limit. It includes a limited number of assessments with readable reports, scored Respondents each month, and seats, as shown in your Workspace. We may change free plan limits, and will give reasonable notice if a change materially affects you.
Trials. A free trial of a paid plan lasts 7 days and needs a card. You pay nothing when it starts. We email you a reminder before it ends. If you do not cancel before the trial ends, it becomes a paid subscription and we charge your card.
Limits never switch an assessment off
Plan limits decide how many reports you can read, not how many people can respond. If you reach a limit, or your trial ends, or a payment fails, your assessment links and invitations keep working, Respondents can still finish, and every response is still scored and kept. Reports beyond your allowance stay locked until you upgrade, and upgrading unlocks them. We will never pause, close or expire an assessment for a billing reason. Only you can do that.
Price changes. If we change the price of a plan you already hold, we will tell you at least 30 days before it applies, and it will only apply from your next renewal. You can cancel before then and never pay it.
Failed payments. If a renewal payment fails, we will tell you and give you a reasonable time to fix it. If it stays unpaid, your Workspace moves to the free plan. Your data is not deleted and your links stay live.
Tax. Australian customers are charged GST where it applies and receive a tax invoice. Supplies to customers outside Australia are generally GST-free. You are responsible for any other sales, use or value added taxes that apply to you, and if you must withhold tax, you pay the extra so we receive the full amount.

Cancelling. You can cancel at any time from Settings, then Billing, in your Workspace, or by emailing support@seemypersonality.com. You do not need to give a reason. Cancelling stops the next renewal. You keep your paid plan until the end of the period you have paid for, and then your Workspace moves to the free plan. Cancelling does not delete your data.
30-day money-back guarantee. If you are not happy with a plan, email support@seemypersonality.com within 30 days of your first payment for that plan and we will refund that payment in full. You do not need to explain why.

Nothing in this section limits a refund you are entitled to under the Australian Consumer Law or another law that applies to you.
In shortYou own it and you control it. We process Respondent Data only on your instructions, to run the Services for you.
You own Your Content and your Respondent Data. Using the Services transfers no ownership to us. We do not sell it, we do not use it to advertise to anyone, and neither we nor our AI provider use it to train AI models.
You give us a worldwide, non-exclusive, royalty-free licence to host, store, back up, copy, process, display and transmit Your Content and Respondent Data, only as needed to provide, secure, support and improve the Services for you. Our service providers may exercise this licence on our behalf. It ends when the data is deleted, except for copies in backups, which clear on their normal cycle, and anything the law requires us to keep.
Who is responsible for Respondent Data. For Respondent Data collected through your Workspace, you are the controller (or business, or APP entity, depending on the law that applies) and we are your processor (or service provider). We act on your instructions and do not use it for our own purposes. For your own account and billing details, we are the controller, and our privacy policies for SMP Assess and SeeMyPersonality apply. If you need a data processing agreement, including standard contractual clauses, email support@seemypersonality.com.
As the controller, you are responsible for:
Sharing. You choose who sees reports. Share links for reports and interview kits expire after 7 days by default, and public report pages can be set to public, password protected or private. Anyone who has a working link can see what it shows, so share links only with people who should see them.
Where data is held. We use carefully chosen providers to run the Services, including Supabase (database), Vercel (hosting), Cloudflare (storage and delivery), Stripe (payments), SendGrid (email), OpenAI (AI features) and our own analytics servers in the European Union. Data may be stored in or accessed from the United States, Australia, the European Union and other countries where these providers operate. We give you a current list of subprocessors on request.
Security. We use reasonable technical and organisational measures to protect data, including encryption in transit, access controls and audit logging of AI generations. No online service can promise perfect security. We will tell you without undue delay if we become aware of a breach that affects your Respondent Data.
Aggregated insight. We may use de-identified, aggregated statistics, such as average completion times or score distributions across many assessments, to improve our instruments, norms and Services. These never identify you, your organisation or any Respondent.
In shortPersonality is one input. Keep a person in charge of every decision, and follow the employment laws where you and your Respondents are.
Our reports describe personality tendencies measured by established research instruments. They are useful for structured interviews, onboarding, team development and conversation. They do not measure ability or integrity, they do not diagnose anything, and they do not predict with certainty how someone will perform. When you use them to make decisions about people, you agree to the following.
We provide tools such as adverse impact reporting to help you monitor your processes. Using them does not by itself make your process lawful, and we do not guarantee any hiring or workplace outcome.
In shortAI helps you draft faster. It can be wrong, so review what it produces before you use it.
Some features use artificial intelligence, for example to draft an assessment from a job description, suggest interview questions, or write report summaries and feedback. To do this we send the relevant input, which may include job descriptions, your prompts, scores and, where a feature needs it, a Respondent's name, to our AI provider, OpenAI. Our provider's terms do not allow it to use that data to train its models. Each generation is recorded in your Workspace's AI audit log.
Check the output. AI can produce text that sounds confident and is wrong, incomplete or biased. Review anything an AI feature produces before you publish it, send it or rely on it. AI features are a drafting aid, not an automated decision-making system, and must not be used as one.
As between you and us, you own the output your Workspace generates and may use it for any lawful purpose. Similar inputs can produce similar outputs for other users, so output may not be unique. Output is not legal, medical, psychological or other professional advice.

We do not monitor content in advance, but we may review and remove anything that we reasonably believe breaks this section or the law. Where we can, we will tell you what we did and why. To report content that infringes your rights or is being misused, email support@seemypersonality.com with the link and details, and we will respond within 5 business days.
In shortThe platform, instruments and reports are ours. You get a licence to use them for your own organisation.
We own the Services and everything in them that is not Your Content or Respondent Data, including the software, assessment instruments, items, scoring, norms, report designs and text, templates, and the SMP Assess and SeeMyPersonality names and logos. While you comply with these terms, we give you a limited, non-exclusive, non-transferable licence to use the Services for your own organisation's internal purposes, and to share reports with the people involved in your processes.
You may say that you use SMP Assess. You may not use our names or logos in a way that suggests we endorse you. We will not name you as a customer without your permission.
If you send us feedback or suggestions, we may use them freely without owing you anything.
In shortWe work hard to keep things running and improving, and we tell you before changes that take something away.
We monitor the Services and work to keep them available, but they run over the internet and we do not promise uninterrupted or error-free operation unless we have agreed a service level with you in writing. We try to schedule disruptive maintenance outside business hours and give notice where we reasonably can.
Support is available through our contact pages and at support@seemypersonality.com. We aim to reply within one business day (Sydney time).
We improve the Services continuously, so features are added, changed and sometimes retired. If a change materially reduces what a paid plan you hold can do, we will give you at least 30 days' notice, and you can cancel before it takes effect and receive a refund of the unused part of any prepaid period. Features labelled beta, preview or early access may change or be withdrawn at any time and are provided as they are.
The Services connect to third parties, such as Stripe, sign-in providers and sites where you embed or share links. Their own terms apply to your use of them, and we are not responsible for their services.
In shortYou can leave any time. We only suspend for serious reasons, we tell you why, and you get 30 days to take your data.
You can leave any time. Cancel your subscription as described above. To delete your Workspace and everything in it, the Workspace owner can open Settings, choose the Workspace tab, and select Delete workspace at the bottom of the page. Deletion is immediate and permanent: any subscription is cancelled with no further charges, assessment links and invitations stop working, and team logins that belong to no other Workspace are deleted. Copies in backups clear within 90 days, and we keep only what the law requires. If you cannot sign in, email support@seemypersonality.com from the owner's email address and we will delete the Workspace for you within 30 days.
A Respondent's data can be removed without deleting the Workspace. Ask us at support@seemypersonality.com and we will delete it within 30 days.
When we may suspend or close an account. Only if you seriously or repeatedly break these terms, the account creates a real risk of harm to Respondents, other users, us or our systems, or a law, court, regulator or payment provider requires it. We will give you notice and our reasons first, unless the law prevents it or waiting would allow serious harm to continue. If you think we got it wrong, reply to our notice and a person will review it. If we suspended you by mistake, we restore access and extend your subscription for the time you lost.
Getting your data out. On request we will give you a copy of your assessments and results in a common machine-readable format within 30 days, so ask before you delete a Workspace yourself. If we close your account for any reason other than a legal requirement, you have at least 30 days to ask for that copy before we delete the data.
Sections on your content and Respondent Data, hiring, our intellectual property, liability, and the general terms continue after your account ends, along with anything else that by its nature should.
In shortYour statutory rights always apply. Beyond them, liability on both sides is capped at a fair, clear amount.
Australian Consumer Law
Our services come with guarantees that cannot be excluded under the Australian Consumer Law. Nothing in these terms excludes, restricts or modifies any right or remedy you have under that law, or under any other law that cannot lawfully be excluded, including the consumer laws of the country where you live. Where the law allows us to limit our liability for failing to meet a guarantee, our liability is limited, at our option, to supplying the services again or paying the cost of having them supplied again.
What we promise. We provide the Services with due care and skill. Beyond that, and beyond any guarantee that cannot be excluded, the Services are provided as they are and as available. We do not warrant that they will meet your particular requirements, or that results, reports or AI output will be accurate, complete or lead to any particular decision or outcome.
Limits. To the extent the law allows:
These limits do not apply to liability for death or personal injury caused by negligence, fraud, wilful misconduct, your obligation to pay fees, or anything else that cannot be limited by law.
Our indemnity. We will defend you against any third-party claim that the Services, as we provide them, infringe that party's intellectual property rights, and pay the resulting damages or settlement we agree to. This does not apply to claims caused by Your Content, by combining the Services with things we did not provide, or by your breach of these terms. If a claim arises, we may modify the Services so they no longer infringe, get you a right to keep using them, or end the affected part and refund the unused part of any prepaid period.
Your indemnity. If you use the Services for a business or organisation, you will defend us against any third-party claim, including one by a Respondent or a regulator, arising from Your Content, your collection or use of Respondent Data, decisions you make using the Services, or your breach of these terms, and pay the resulting damages or settlement you agree to. This is reduced to the extent the claim was caused by our own breach or negligence.
For either indemnity, the party claiming it must tell the other promptly, let it control the defence and settlement (no settlement may impose an admission or obligation on the protected party without its consent), and give reasonable help at the other party's cost.
In shortWe give 30 days' notice of changes that matter, we try to fix problems by talking first, and New South Wales law applies.
Changes to these terms. If a change materially affects your rights, we will give you at least 30 days' notice by email or in the Services before it takes effect. If you do not accept it, you can cancel before then and we refund the unused part of any prepaid period. Minor changes, such as clarifications or corrections, take effect when we publish them. The date at the top of this page shows when these terms last changed, and we will send you an earlier version on request.
Talk to us first. If something goes wrong, email support@seemypersonality.com and we will try to sort it out. We both agree to try in good faith to resolve any dispute for 30 days before starting court proceedings. This does not stop either of us seeking urgent relief, or stop you complaining to a consumer protection regulator, such as the ACCC or your local fair trading body.
Governing law. These terms are governed by the laws of New South Wales, Australia, and we both submit to the non-exclusive jurisdiction of its courts. If you are a consumer, you also keep the protection of the mandatory laws of the country where you live and any right to bring proceedings in your local courts.
